These Terms of Service govern your use of ListMotion, including listmotion.com.au, trylistmotion.com, and any related ListMotion services.
By placing an order or using ListMotion, you agree to these terms. If you do not agree, you must not use the service.

ListMotion generates AI-assisted property marketing videos from listing photos, property information, agent details, logos, and branding assets you provide.
You upload or select photos and provide the relevant details. We generate and deliver a branded property video to the email address you provide.
Each order is for a single video in your chosen format, unless otherwise stated at checkout.

You are responsible for reviewing the final video before publishing, sharing, uploading, advertising, or otherwise using it.
ListMotion uses AI and automated video tools to create motion and assemble videos from the photos and details you provide.
AI-generated outputs may contain visual artefacts, distortions, unintended changes, or other imperfections. These may include changes to objects, surfaces, lighting, perspective, reflections, shadows, fixtures, fittings, views, landscaping, room appearance, or other visual details.
You must review the final video before using it in any marketing or publication.
You must ensure the video does not misrepresent the property, including its condition, layout, inclusions, fixtures and fittings, views, surroundings, dimensions, finishes, features, location, availability, or price or campaign details.
ListMotion videos are marketing assets. They are not property inspections, factual property records, valuation tools, floorplans, building reports, legal representations, or substitutes for verifying property details.
ListMotion is not responsible for claims arising from your publication or use of a video that you have not reviewed, that contains inaccurate information supplied by you, or that you use in a misleading way.
You retain ownership of the photos, logos, branding, text, property information, and other materials you upload or provide.
By providing materials to ListMotion, you grant us a limited licence to host, copy, store, process, modify, render, transmit, and use those materials solely for the purpose of generating your video, rendering and assembling your video, delivering the completed video, providing customer support, troubleshooting technical issues, and maintaining the security, reliability, and operation of the service.
This licence ends when the materials are no longer required for those purposes, subject to any retention periods described in our Privacy Policy.
Subject to your compliance with these terms and successful payment, you are granted a perpetual, non-exclusive licence to use the generated video for commercial real estate marketing purposes.
This includes use on real estate portals, agency websites, social media, email marketing, vendor reporting, presentations, and digital advertising, provided your use complies with applicable laws, platform rules, and third-party rights.
We will not use your uploaded photos, property address, branding, or finished video in public marketing without your permission.
We may use non-identifiable, aggregated usage information to improve, describe, or promote the service.
We will use reasonable efforts to deliver your video to the email address you provide within the estimated delivery time shown on the website or at checkout.
Delivery times are estimates only. Delivery may be affected by upload quality, file size, system load, third-party provider availability, payment processing, email delivery issues, or other technical factors.
If your video cannot be generated or delivered due to a ListMotion system issue, we may offer to regenerate the video, correct the issue, or provide a refund in accordance with our Refund Policy.
The quality of the final video depends on the quality, resolution, composition, lighting, and suitability of the photos you provide.
Because ListMotion uses AI and automated rendering tools, we do not guarantee a specific artistic, creative, commercial, or aesthetic outcome.
We do not guarantee that the video will improve listing performance, generate enquiries, secure appraisals, sell a property, or achieve any specific marketing result.
If the output has a technical issue, such as being corrupted, incomplete, unplayable, delivered in the wrong selected format, or missing required branding due to a ListMotion system error, we will take reasonable steps to resolve it or provide a refund in accordance with our Refund Policy.
We do not guarantee that a video will be accepted, approved, displayed, boosted, or published by any third-party platform, including real estate portals, social media platforms, advertising platforms, agency CRMs, email platforms, or listing management systems.
You are responsible for checking and complying with each platform's technical requirements, advertising policies, content rules, copyright requirements, and real estate marketing obligations.
All payments are processed securely by Stripe.
Prices are shown in Australian dollars (AUD) and include GST where applicable, unless otherwise stated.
You must provide accurate payment and billing information. An order may not begin processing until payment has been successfully received.
Orders are refundable only in the circumstances described in our Refund Policy or where required by Australian Consumer Law.
For most technical issues, we may first offer to regenerate, correct, or redeliver the video at no additional cost. If we cannot reasonably resolve the issue, we may provide a refund for the affected order.
Change-of-mind refunds are not provided unless required by law.
ListMotion may be offered as a beta, pilot, early-access, or evolving service.
Features, delivery times, pricing, supported formats, integrations, AI models, output quality, and service availability may change over time.
We may update, modify, suspend, or discontinue parts of the service where reasonably necessary.
We may refuse, cancel, suspend, or refund an order if we reasonably believe that the uploaded materials are unlawful, misleading, offensive, inappropriate, or infringe third-party rights; you do not have the required rights or permissions to use the materials; the order creates technical, legal, security, or operational risk; the request is outside the intended use of the service; the service is being misused; or payment has failed, been reversed, or appears fraudulent.
Our collection and use of personal information is described in our Privacy Policy.
By using ListMotion, you agree that we may collect, use, process, and store information as described in that policy.
Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted, or modified.
If the service fails to meet a consumer guarantee, you may be entitled to a remedy under Australian Consumer Law.
To the extent permitted by law, ListMotion's liability for any claim arising from or relating to the service is limited to the amount paid for the affected order.
To the extent permitted by law, we are not liable for indirect, consequential, incidental, special, exemplary, or loss-of-profit damages, including loss of sales, lost enquiries, lost listings, reputational harm, platform rejection, campaign performance, or business interruption.
This limitation does not apply where liability cannot be excluded or limited under Australian Consumer Law or other applicable laws.
You agree to indemnify ListMotion against claims, losses, damages, liabilities, costs, or expenses arising from materials you upload or provide; your breach of these terms; your misuse of the service; your publication or use of a generated video; any allegation that your uploaded materials or use of the video infringes third-party rights; or any misleading, inaccurate, unlawful, or non-compliant property marketing caused by information or materials you provided or approved.
These terms are governed by the laws of Victoria, Australia.
You agree to submit to the courts of Victoria, Australia, in relation to any dispute arising from these terms or your use of ListMotion.
We may update these terms from time to time. The latest version will be published on this page with the updated date.
Your continued use of ListMotion after changes are published means you accept the updated terms.
